- Printed serialized ticket generation
- QR validation and scanning
- Box office allocation tracking
- Reconciliation reporting
- Payment processing facilitation
BajanTix.com is a technology provider and marketplace facilitator only. BajanTix.com does not organize, manage, or operate events, control event venues, guarantee attendance, or guarantee promoter profitability. The Promoter is solely responsible for the event.
2. Promoter Representations & Warranties
Promoter represents and warrants that:
- It has legal authority to organize and sell tickets for the event.
- It has secured all required permits and licenses.
- It maintains appropriate insurance coverage.
- Event information provided is accurate and not misleading.
- It will comply with all applicable Barbados laws.
Promoter is fully responsible for event execution, safety, staffing, security, and compliance.

4. Ticket Sales & Payment Processing
4.1 Collection of Funds
BajanTix.com collects ticket payments as limited payment agent for Promoter. Funds are held for settlement subject to service fees, processing fees, refunds, chargebacks, and fraud review.
4.2 Fees
BajanTix.com retains agreed service fees per ticket. Fees are non-refundable except where required by law.
4.3 Payout Timing
Payouts may occur after the event date or according to agreed settlement schedule. BajanTix.com reserves the right to delay payouts pending fraud or dispute review, establish rolling reserves, and offset refunds or chargebacks against future payouts.
5. Chargebacks & Fraud
Promoter acknowledges that chargebacks are a known risk of card-based transactions. Promoter agrees to bear financial responsibility for chargebacks, that BajanTix.com may withhold funds to cover anticipated disputes, and that BajanTix.com may deduct disputed amounts from payouts.
If fraud rates exceed acceptable thresholds, BajanTix.com may suspend ticket sales, require additional security measures, or terminate event listing.
6. Printed Ticket System
If Promoter elects to use printed tickets:
- Tickets are serialized and QR-coded.
- Ticket ranges may be allocated to specific box office partners.
- BajanTix.com tracks issuance and redemption.
Promoter is responsible for secure storage of printed ticket stock, oversight of box office staff, and cash handling outside digital payment channels.
BajanTix.com is not liable for lost or stolen printed inventory, misuse by third-party box offices, or cash reconciliation discrepancies.
7. Box Office Allocation & Reconciliation
BajanTix.com provides reporting tools to track ticket allocations, monitor scan counts, and reconcile sold vs. scanned tickets. Promoter remains responsible for physical cash reconciliation, staff conduct, and accurate reporting by box office partners.
8. Event Cancellation & Refunds
Promoter is solely responsible for funding refunds, public communication regarding cancellations, and alternative arrangements.
If refunds are required, BajanTix.com may process refunds from retained funds. Processing fees may not be refundable. If retained funds are insufficient, Promoter must immediately remit deficit amounts.
Failure to fund refunds may result in account suspension, legal recovery, or reporting to payment processors.
9. Entry & Scanning
Ticket validation is based on unique QR tokens, scan timestamp, and first-valid-entry logic. Duplicate scans invalidate entry. BajanTix.com is not liable for venue overcrowding, security failures, or manual override decisions by event staff.
10. Taxes
Promoter is responsible for VAT, entertainment taxes, local levies, and government reporting. BajanTix.com does not provide tax advice.
11. Intellectual Property
Promoter grants BajanTix.com a limited license to display event branding, use logos for promotional purposes, and promote events via Platform marketing. Promoter warrants it owns or has rights to uploaded content.
12. Indemnification
Promoter agrees to indemnify and hold harmless BajanTix.com from claims arising out of event injuries, promoter negligence, permit violations, refund failures, marketing misrepresentations, regulatory violations, and data misuse outside Platform scope. This survives termination.
13. Limitation of Liability
To the maximum extent permitted by law, BajanTix.com shall not be liable for lost profits, reputational damage, indirect or consequential damages, event-related injuries, venue issues, or force majeure events. Total liability shall not exceed the total fees paid to BajanTix.com in the preceding 12 months.
14. Suspension & Termination
BajanTix.com may suspend or terminate access for fraud risk, excessive chargebacks, regulatory concerns, breach of Agreement, or reputational harm. Upon termination, outstanding fees remain due and refund obligations remain Promoter's responsibility.
15. Force Majeure
Neither party is liable for delays caused by natural disasters, government orders, utility failures, or internet disruptions. Promoter remains responsible for event-related obligations.
16. Confidentiality
Both parties agree to protect confidential business information exchanged during the relationship.
17. Governing Law & Disputes
This Agreement is governed by the laws of Barbados. Disputes shall be resolved by good faith negotiation, then by mediation in Barbados, and if unresolved, in the courts of Barbados. Promoter waives participation in class actions to the extent permitted by law.
18. Entire Agreement
This Agreement, together with the Terms & Conditions, Privacy Policy, and Data Processing Addendum constitutes the entire agreement between the parties.
